II. RULES & REGULATIONS

RULE XXIX

​

GENERAL SAFETY RULES

   

1. While classes are in progress, students are strictly enjoined to stay inside their classrooms and not to loiter in the corridors or hallways. If, for any reason, it becomes necessary for the student to leave the room, he should do so only with the knowledge and expressed consent of the professor/instructor.

​

2. When classes are not in session, or no professor or instructor is present, students should keep off armories, laboratories, machine shops or similar places within the school premises, especially where there are inflammables kept, or noxious and dangerous substances are stored.

​

3. Billiard halls, pool rooms, bars, or similar places near the school campus which may be offensive to health, safety, or morals should be avoided by the students. A student who goes to such places when he/she should be inside the classroom or in the library during vacant periods, recess time, or class break, wastes rather than utilizes, precious time.

​

4. When walking o the corridors or stairways, student shall always keep to the right to ensure the orderly and easy flow of human traffic. They should refrain from performing any act which would harm or intend to cause harm to themselves or to others.

​

5. Students who meet an accident or suffer an injury while in the campus should be treated or caused to be treated at the medical or dental clinics of the COLLEGE.

​

6.    Students shall not involve themselves in the use of prohibited drugs and narcotics, the possession, use, or                distribution of which is not allowed. Random Drug Testing shall be implemented pursuant to Sec 36© of Article III of Ra 9165 otherwise known as the Comprehensive Dangerous Drug Act of 2002

​

7. Students having questions about the medical aspect  of any illegal drug should feel free to consult with COLLEGE physician or any competent member of his staff.

​

8. Possession and use of firearms and other lethal weapons, such as firearms, bladed weapon, chaco, ice pick, and other weapons of the same nature, as well as explosives, pyrotechnics and similar articles or object which cause public disturbance, or disrupts the peace and order of the campus, or are likely to cause the same, are strictly prohibited in the school premises. Any violation of this RULE may subject the offender to criminal prosecution.

​

9. Hazing is strictly prohibited. No student, alone or in conspiracy with others, shall engage in hazing or commit any act that injures, degrades, disgraces, or which tends to cause, injury, degradation, or disgrace to any fellows student in the COLLEGE.

​

10. No off-campus activity, such as field trips, excursions, or any other similar extra-curricular activities shall be held except when absolutely necessary, or as the Director of Student Services, allows in which case all possible precautions to safeguard the lives, health and property of the students shall be taken by the adviser accompanying them.

​

11. In case of accident arising on the occasion of any such campus activity, the faculty adviser shall take immediate steps to have the injured taken to the nearest hospital or clinic and shall report said accident to the proper local and school authorities.

​

12. In case of emergency such as fire, earthquake, tornado, or any similar unforeseen events, student should always keep their presence of mind and should take steps as are necessary to insure their safety, like keeping away from falling objects and debris or from live wires during fire and earthquakes, or from open spaces in case of bomb explosions campus.

​

13. In case of imminent danger to his life or from any cause within the campus, any student may ask the aid and assistance of any school personnel to such extent as may be necessary toward of the threat or danger, or may, for the same purpose, make use of any available facilities of the COLLEGE. No official or representative of the COLLEG shall deny or cause to be denied to any student such assistance or access to facilities, except if by doing so, he unduly exposes himself to the same or greater danger.

​

14. In the interest of campus security, all persons entering the school premises shall be subject to search by the security guard/s and other members of the security force.

​

15. Every student shall always act with due regard to his health and safety and with due respect to the equal rights of his fellow students to their unimpaired health and safety, while in the campus, including recess time, or while engaged in such activities as physical education, athletic games, exercises, or sports competition.

​

16. Students  are required to observed and comply strictly with all the safety rules and regulations herein or which may hereafter be prescribed by the COLLEGE, as well assigns and posters displayed on campus, or oral instructions and orders which any authorized school official may, in special circumstances, give or render, in order to avoid injury or damage to persons and property.

RULE XXXI

​

RULES ON DISCIPLINE

​

The AKLAN POLYTECHNIC COLLEGE aims to mould its student into a TRUE FILIPINO, that is men and women who are mentally, intellectually, physically, socially, culturally, spiritually and morally prepared to meet the demands of the times. To achieve this ideal, the COLLEGE has established rules and regulations concerning student affairs, conduct and discipline.

​

Major Offenses -  A major offense is one which merits suspension or expulsion. The following are considered major offense:

 

1. False Information - Refers to the submission by a Student of false or misleading statements in his 

official documents filed with the COLLEGE, including publishing or circularizing false and derogatory 

information about the COLLEGE, its official faculty members and students.

 

2. Tampering or forging school records and securing/using such forged materials.

 

3. Cheating - The following constitute cheating:

a. Unauthorized possession of any notes or any materials relative to the examination, quiz/test whether 

the student actually uses them or not.

b. Deliberately looking at a seatmate’s answer sheet or examination booklet.

c. Copying from or allowing another to copy from one’s examination booklet.

d. Having somebody else take the examination for another (both shall be liable hereunder).

e. Talking with another without permission during an examination.

f. Deliberately talking or conferring with another during an examination,

g. Passing as one’s own work any assigned report, and the like, when it is actually copied from another.

​

An additional sanction for this is loss of credit for the subject wherein the offense is committed and other penalties that may be imposed as proper and appropriate.

 

4. Act of lewdness and commission of immorality, including distribution of pornographic material within the COLLEGE premises.

 

5. Stealing within the COLLEGE premises.

 

6. Drunkenness -  Entering the COLLEGE premises, classrooms, libraries, or offices while the student is in a state of intoxication.

 

7. Gambling - In any form within the school premises.

 

8. Vandalism - Any willful destruction or defacing of any school property belongs to this category. The offenses includes, but is not limited to such acts as tearing off or defacing of any library book, magazine and periodical. Writing or drawing on the walls and pieces of furniture; breakage of glass windows, cabinet doors, electrical/mechanical devices or appliances; unauthorized removal of official notice/posters from bulletin boards, and other similar offenses;

 

9. Carrying of deadly weapons as this term is defined in our laws, within the COLLEGE premises.

 

10. Any assault or attempt thereof upon student teacher, or professor, COLLEGE authority or personnel within the actual premises including any defamation committed against him.

 

11. Rule on fraternities and sororities - The Institution does not allow nor recognized any organization including but not limited to sororities and fraternities formed in or outside the school, without it’s written and sealed authority. And organization must follow the prescribed rules stated in the handbook before it gains recognition. Any student found in violating this rule would be subjected to disciplinary actions determined by the school.

 

12. Gross acts of disrespect, in words or in deeds, which tend to put members of the faculty, administration or non-academic staff in ridicule or contempt.

 

13. Unlawful Concerted Activities - Any misbehavior of a student that causes substantial disturbance/disruption of class/es.

 

14. Unlawful Concerted Activities - Instigating, leading or participating by means of violence, force intimidation, coercion, or by any unlawful acts resulting in a  temporary stoppage of classes or preventing other students from attending their classes or faculty members and other personnel of the COLLEGE from performing their official functions. In appropriate cases, court actions may be taken by the COLLEGE authorities against any student who violates the pertinent provisions of the Revised Penal Code.

 

15. Narcotics and Prohibited Drugs - The use, possession, sale or distribution of narcotics or dangerous drugs, such as marijuana, shabu, ecstasy tablet or lysergic acid diethylamide (LSD) except as permitted by law.

 

16. Cybercrime

20. Plagiarism

​

 

Minor Offenses - All offenses not included in the foregoing enumeration including but not limited to:

​

1. Disturbing one’s own class or that of another.

 

2. Entering the campus without an Identification Card (ID) or using a tampered Id or someone else’s ID Card.

​

3. Failure to wear the prescribed uniform.

 

4. Littering

 

5. Smoking within the school premises.

 

6. Breaking into a school function without permission from those concerned.

 

7. Unauthorized selling or solicitation of funds for any purpose in violation of RA 5546.

 

8. Other offenses which disturb the peace and order of the school unless properly classified as a major offense.

 

9. Use of cell phones inside the Library, laboratory and classroom when classes are going on.

 

10. Violation of posting regulations

 

11. Any act prohibited in this Student Handbook that is not classified as a major offense on the

commission of which does not carry with it a specific sanction.

​

 

SANCTIONS 

​

I. For Major Offenses

a. Probations with automatic suspension for the rest of the semester in case of violation of the condition imposed thereof.

b. Suspension, the length of which will depend on the decision of the Board of Discipline.

c. Dismissal from the COLLEGE.

d. Expulsion after favorable action by DepEd/CHED.

​

II. For Minor offenses

a. Warning/admonition from the Dean or Head of the academic unit or from the Coordinator of Student Affairs.

b. Summoning of parents or guardian or any responsible person charged with the case of the student in cas of second offense.

c. In case of a minor personal offense, written apology to the person concerned.

​

​

The Board of Discipline

I. Composition

1. Director, Student Affairs & Services (Chairperson)

2. Concerned College Dean

3. Faculty Representative or Head of the academic unit to which the respondent belongs;

4. The President of the Central Government or an COLLEGE or a Student Representative duly appointed 

    by the School Director

5. Guidance Counselor

6.  Discipline Officer

7.  School Director (ex-officio)

​

II. Jurisdiction

1. The Board of Discipline shall take cognizance of all major offenses involving student discipline. Any student who refuses to submit to the jurisdiction of the board after notice may be suspended until such time as he submits himself to penalty.

2. The SAS Director shall take cognizance of and decide minor offenses.

 

 

RULE XXXII

 

SUMMARY PROCEEDINGS

 

The maintenance of an atmosphere conductive to study and the safety of the students within the COLLEGE premises are the primary concerns of the COLLEGE ADMINISTRATION. In order to carry out these responsibilities effectively, it is necessary to resort to summary proceedings as follows:

 

In case where students are caught in the act of committing any of the offense enumerated in this HANDBOOK or in cases of rumbles of tumultuous fights, boycotts, by force or coercion, or unauthorized /illegal demonstrations, the College Dean and the Coordinator of Student Affairs are given the authority by te COLLEGE President the impositions of sanctions, the nature and duration of which shall depend on the gravity of the offense and which shall be final and executor upon approval. A record of said sanction shall be entered into the student folio.

​

Original records pertaining to student discipline shall be under the custody of the College Dean, the Office of the Dean of Discipline, and the Guidance Center.

 

Steps in Summary Proceedings

 

The respondent is summoned to appear before the College Dean concerned. He is informed of the charge against him and afforded the opportunity to present his side.

 

2. The refusal of the respondent to appear before the College Dean after due service of summons without sufficient cause shall be construed as admission of guilt observing appropriate sanction.

 

 

 

 

RULE XXX1II

 

GRIEVANCE COMMITTEE

 

Grievance against any member of the A.P.C. community are best resolved by peaceful dialogue and discussion and a formal procedure to settle a grievance shall be taken only as last recourse.

 

Only when a grievance is express in writing and duly signed by the party/parties involved under oath does it become a formal complaint needing a formal procedure for settlement.

 

In order to formalize the resolution of a grievance, a Grievance Committee shall be organized, the composition of which shall depend on the type of grievance as herein described.

 

Procedures for various type of cases are contained in this section.

 

 

I. An individual Student’s Complaint Against a Faculty Member

The student presents his complaint, in writing, to the faculty member concerned who shall take action on the complaint not later than one (1) week from receipt thereof.

 

b. If the complainant does not obtain the necessary action on his complaint after one (1) week from the date he presented the complaint to the faculty concerned, he submits a written complaint to the faculty member concerned to the College Dean.

 

c. Immediately after the receipt of the complaint, the Dean convenes the School Ad Hoc Grievance Committee 

 

d. Any party not satisfied with the decision rendered may file a motion for reconsideration stating the grounds therein. Within five (5) days from receipt of the written decision, provided neither party has availed of such remedy within the prescribed period, the decision of the Committee become final and executory.

​

II. A class complaint Against a Faculty Member. 

 a. A formal written complaint is submitted to the Head of the Department to which the faculty member complained against belongs duly signed by at least fifty (50%) percent plus one of the class. The class elects a committee of three representatives to see the Department Head. The Department Head has 72 hours to investigate and settle the complaint.

b. If he class members feel that necessary action on  the complaint has not been taken after the prescribed time, the class representatives will present their written complaint to the College Dean.

c. Immediately after the receipt of the complaint, the College Dean convenes the Student Ad Hoc Grievance Committee which shall resolve the complaint as soon as possible, preferably within a week.

d. Any party not satisfied with the decision rendered may file a motion for reconsideration stating the grounds therefore. Within five (5) days from receipt of the written decision, provided neither party has availed of such remedy within the prescribed period, the decision of the Committee becomes final and executor.

 

III. Statement of Sexual Harassment

The COLLEGE is committed to the protection of its students from sexual harassment which is defined an unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of sexual nature when:

a. Submission to such conduct is made expressed or unexpressed, explicitly or implied a term or condition of a student’s education advancement.

b. Submission to or rejection of such conduct by a student is used as the basis for academic consideration affecting the student.

c. Such conduct has the purpose or effect of substantially interfering with a student’s academic performance or creating an intimidating, hostile, or offensive educational environment.

 

Any student having a complaint of sexual harassment should follow the steps required for a complaint made by a student against a faculty member as provided for in this Section.

 

IV. Composition of the School Ad Hoc Grievance Committee.

a. The Head of the Department to which the faculty member complained against belongs, who shall serve as Chairman of the committee.

b. If both the complaint/s and the respondent belongs to the same department, the Governor of the Student Council of that department. If they belong to different academic units, the Governor of the Student Council of their respective units.

c. If both the complainant/s and respondent belong to same academic unit, the President of the Faculty Association of said unit, but in the absence of said association, the College Dean shall designate the faculty member who shall represent the unit in the committee.

d. In case any of the above is the complainant or a respondent, his place in the Committee will be taken over by another official representative of the sector, preferably the next line.

e. Appeals for reconsideration of decisions made by any School Ad Hoc Grievance Committee shall automatically be elevated to the Board of Discipline.

RULE XXXIV

 

EFFECTIVITY

 

By  authority of the Aklan Polytechnic College Board of Trustees, the updated Handbook shall take effect as of the First Semester of School Year  2020-2021.
